Terms of Sale
A prospective bidder must pay $10,000,000.00 in immediately available funds as a deposit (the “Deposit”) into escrow with Fidelity National Title Insurance Company, Boston office (“Escrow Holder”) by noon on the day prior to the date of the sale, and deliver to Escrow Holder a fully completed and executed escrow agreement with the Escrow Holder (the “Escrow Agreement”) & a W-9 together with or prior to paying the Deposit, in order to qualify as a bidder. The form of Escrow Agreement may be obtained from Sullivan & Sullivan Auctioneers, LLC, 148 Route 6A, Sandwich, MA 02563, Email: info@Sullivan-Auctioneers.com, Website : Sullivan-auctioneers.com. The Deposit shall be a non-refundable earnest money deposit towards the purchase price to be held at the option of Mortgagee as liquidated damages for any default by the successful bidder. The successful bidder will be required to execute a Memorandum of Sale immediately after the close of the bidding. The successful bidder shall pay the balance of the purchase price by wire transfer in immediately available funds no later than the first business day that falls thirty (30) calendar days after the date of the sale (the “Closing Date”). Closing of the sale shall be in escrow with Escrow Holder, or elsewhere as agreed by the parties, on the Closing Date, and upon closing the foreclosure deed shall be delivered to the successful bidder upon release of all purchase price funds to Mortgagee.
